Qweek Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Qweek platform (“the Service”), owned and operated by Tellsen Digital Solutions Limited (“the Company”, “we”, “our”, “us”), a company registered under Nigerian law.
By accessing or using Qweek, you (“you”, “your”, “User”, or “Merchant”) agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About Qweek
Qweek is a digital restaurant management software and QR code menu system that allows merchants to manage orders, menus, and tables through an online platform.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use Qweek. By using Qweek, you warrant that you are legally capable of entering into a binding agreement and that all information you provide is accurate.
3. Service Charges
  • Qweek is offered with a one-time setup fee communicated at the time of registration.
  • Additionally, a service charge of NGN 100 per completed customer order applies to all orders processed through Qweek, including during any trial period.
  • All fees are non-refundable except where expressly agreed otherwise in writing by Tellsen Digital Solutions Limited.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. You agree to notify us immediately of any unauthorized use of your account.
We are not liable for any losses or damages arising from your failure to protect your account information.
5. Permitted Use and Restrictions
You agree to use Qweek only for lawful purposes and in accordance with these Terms.
You may not:
  • Use the platform for fraudulent, deceptive, or illegal activities.
  • Attempt to reverse engineer, decompile, or otherwise tamper with the software.
  • Use the platform to harm, harass, or exploit customers, staff, or other users.
We reserve the right to suspend or terminate your access if we suspect or detect misuse, fraud, or violation of these Terms.
6. Intellectual Property
All intellectual property rights in Qweek, including software, branding, and content, remain the exclusive property of Tellsen Digital Solutions Limited. You are granted a limited, non-exclusive, non-transferable license to use Qweek solely for your business operations.
7. Data Protection and Privacy
We process your personal and business data in accordance with the Nigerian Data Protection Act 2023, and applicable international data privacy laws. By using Qweek, you consent to our collection and use of your data as described in our Privacy Policy.
You are responsible for complying with all applicable data protection laws when handling your customers’ information through Qweek.
8. Limitation of Liability
Qweek is provided “as is” and “as available.” To the fullest extent permitted by law:
  • We disclaim all warranties, express or implied.
  • We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of business, revenue, or data.
  • Our total liability to you for any claims arising under these Terms shall not exceed the total amount of service charges paid by you in the preceding 3 months.
9. Indemnity
You agree to indemnify and hold harmless Tellsen Digital Solutions Limited, its directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your misuse of Qweek, violation of these Terms, or breach of applicable laws.
10. Termination
We may suspend or terminate your access to Qweek at any time if you breach these Terms, misuse the platform, or engage in fraudulent or illegal activity. Upon termination, all outstanding charges become immediately due.
11. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website or platform, and continued use of Qweek constitutes acceptance of the revised Terms.
